Terms of Service
These terms set out the agreement between you and Absolute Intelligence UK Ltd for the use of CallAgents AI. Please read them carefully — by using CallAgents AI you agree to be bound by them.
1. About these terms
CallAgents AI ("the Service") is provided by Absolute Intelligence UK Ltd ("we", "us", "our"), a company registered in England and Wales (company number [COMPANY NUMBER]) with its registered office at [REGISTERED ADDRESS].
These terms apply to anyone who uses the CallAgents AI website or service ("you", "your"). Where you use CallAgents AI on behalf of a business, you confirm you have authority to bind that business to these terms.
2. Free trial
CallAgents AI offers a 7-day free trial on all plans, subject to a 30-minute fair use allowance. No payment details are required to start the trial. You can cancel any time during the trial with no charge. After the trial, you'll be invited to choose a plan and provide payment details to continue. If you don't continue, your account closes automatically and we keep your data for 30 days before deleting it.
3. The Service
CallAgents AI provides an automated phone-handling service for businesses. It can answer calls, qualify enquiries, book appointments, take messages, chase outstanding invoices and escalate calls to a human when required, according to the configuration you and we agree.
We will use reasonable skill and care in providing the Service. We do not guarantee that the Service will be uninterrupted, error-free or able to handle every possible call scenario. We will publish a target service level in your customer agreement before you go live.
4. Your obligations
To use CallAgents AI as a customer, you agree:
- To give us accurate information about your business, your services and your customers.
- To use the Service only for lawful purposes and in line with these terms.
- Not to use the Service to make or facilitate unsolicited marketing calls, scam calls, or any call that breaches the Privacy and Electronic Communications Regulations 2003 (PECR) or any other applicable law.
- To pay our fees on time.
- To keep your login credentials secure and to tell us promptly if you suspect they've been compromised.
5. Calls and recordings
CallAgents AI records and transcribes calls. You are responsible for ensuring that you have a lawful basis to record calls made to or from your business, and for informing your callers as required under UK law. We will provide standard wording you can use.
Recordings and transcripts belong to you. We will store them on your behalf for the retention period in your customer agreement, and we will return or delete them on request.
6. Fees and payment
Customer fees are set out in your service plan. Plans are billed monthly in advance. We may change our prices on 30 days' written notice; if you don't accept the new price you can cancel before it takes effect.
7. Cancellation
Customer plans run on a monthly rolling basis. You can cancel any time with no exit fee, and we will not bill you for the following month. Cancellations made part-way through a billing month are not pro-rated.
We may suspend or terminate the Service immediately if you breach these terms in a serious way, if you don't pay, or if we reasonably believe the Service is being used unlawfully.
8. Intellectual property
We own the CallAgents AI software, brand, designs and documentation. You get a non-exclusive, non-transferable licence to use the Service for your business during the term of your customer agreement. You keep ownership of your business data and content.
9. Data protection
Our Privacy Policy explains how we handle personal data. When we process call data on your behalf as a customer, we act as a data processor and you act as the data controller. We will sign a data processing agreement with you before you go live.
10. Liability
Nothing in these terms limits or excludes our liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be lawfully limited.
Subject to the above, our total liability to you in any 12-month period is limited to the fees you have paid for the Service in that period. We are not liable for indirect or consequential loss, loss of profits, loss of business, or loss of goodwill.
CallAgents AI is a tool that supports your business. You remain responsible for the decisions you make based on calls it handles.
11. Changes to these terms
We may update these terms from time to time. If we make a material change we'll tell you in advance. Continued use of the Service after a change means you accept the new terms.
12. Governing law
These terms are governed by the laws of England and Wales. Any dispute will be heard in the courts of England and Wales.
